On Monday, June 13, U.S. Customs and Border Protection (CBP) released Uyghur Forced Labor Prevention Act (UFLPA) operational guidance to alert importers about CBP’s enforcement, which began on June 21, 2022. Importers should review the document to familiarize themselves with CBP’s UFLPA procedures, priorities, and appeals processes. The UFLPA requires CBP to apply a rebuttable presumption that any goods made wholly or in part in the Xinjiang Uyghur Autonomous Region (XUAR) are the products of forced labor. Cotton and polysilicon are specifically identified in the operational guidance. CBP’s operational guidance advises that importers should be prepared to provide significant supply chain documentation.
