Utah regulators now require that online retailers make the law labels for mattresses they sell online easily accessible to Utah consumers before sale. Although this new requirement became effective on January 1, 2024, Utah has announced a period of “soft enforcement” for the new rule until June 1, 2024. During this period, Utah will only issue notices of violation for noncompliance instead of taking punitive action. Utah chose this approach to educate and inform retailers about observed violations and provide them the opportunity to correct the problem without the regulators taking civil or administrative action. 

Under the new rule, an online retailer must meet all of Utah’s labeling requirements that apply to retailers. For example, not only must the mattress being sold to the Utah consumer be labeled and tagged correctly, but the label must also be “easily accessible to the consumer for examination before purchase.” Therefore, online retailers that sell your mattresses to Utah consumers may be requesting your law label information to comply with this new requirement. 

In addition to mattresses, this requirement applies to online sales of all stuffed or filled products (which would include mattress pads, toppers, pillows, comforters, upholstered headboards as well as upholstered furniture). The online label rules apply regardless of whether the mattress or other stuffed or filled product was manufactured in Utah.  

Other states may be considering similar requirements for online retailers.
