Last year, Utah regulators promulgated a rule (R70-101) to require that online retailers make law labels for mattresses (and upholstered furniture) they sell online easily accessible to Utah consumers before sale. Utah implemented this rule on January 1, 2024. By letter dated February 15, 2024, however, Utah announced that it had temporarily repealed that rule effective February 2, 2024, for 120 days. Utah took this action because feedback from the furniture industry demonstrated the difficulty of satisfying the new online label requirements.

Utah explained that this regulatory pause is necessary because “the existing online labeling rule requires further evaluation and refinement to better align with evolving industry standards and the needs of our stakeholders.” ISPA will continue to monitor and provide updates on this regulation.
