MA H 4486, a wide-ranging PFAS bill that combines three existing bills was introduced in Massachusetts. The bill bans intentionally added PFAS in specific product categories, including fabric treatments, upholstered furniture and children’s products manufactured after January 1, 2027. The term upholstered furniture is broad enough to likely include mattresses, and the children’s product definition would include mattresses intended for children 12 and under.  

The bill also includes a blanket ban on any consumer product containing intentionally added PFAS manufactured after January 1, 2031, unless the state determines that the use of PFAS in the product is “currently unavoidable,” in which case the product is temporarily exempt from the PFAS ban at intervals for up to 4 years. 

In addition, H 4486 would require manufacturers of consumer products containing PFAS to report PFAS-related information into a state-mandated database by June 1, 2026. Most troubling, the bill requires manufacturers of several products (including fabric treatments, textiles, textile furnishings, upholstered furniture and children’s products) to establish an audit program to test for unintentionally added PFAS in their products.  The bill does not specify the audit program’s parameters.
