New Hampshire Governor Chris Sununu has ratified NH HB 1649, which bans the use of intentionally added PFAS in certain consumer products. Effective January 1, 2027, the law provides no person may sell or distribute a covered consumer product with intentionally added PFAS. Of relevance to the mattress industry, the list of covered products includes upholstered furniture, textile furnishings, juvenile products and textile treatments. 

Although the bill does not explicitly include adult mattresses in its list of covered products, the defined terms are broad enough that all mattresses (both children’s and adult) are likely covered by the ban. For example, the bill defines “upholstered furniture” to mean an article of furniture designed for sitting, resting or reclining and that contains any filling material; “juvenile product” to include at least the crib and toddler mattresses; and “textile furnishings” to include “bedding.”
