Bill Containing Mattress EPR Study Introduced in Massachusetts
As ISPA previously reported, the Massachusetts Legislature considered multiple mattress extended producer responsibility (EPR) bills in the 2024 legislative session. None of these bills were enacted during the formal legislative session that concluded on July 31, 2024.
During the informal session in Massachusetts, MA S 2967, a compromise energy bill was released from a conference committee. The bill contains a provision to create a special legislative commission to recommend EPR policies to the Massachusetts Legislature. The commission is tasked with recommending detailed EPR programs and strategies by January 15, 2026, for “product and packaging categories including, but not limited to, paint, mattresses, electronics, lithium-ion batteries, plastics and other packaging.”
The commission must host at least four public meetings and solicit public comment on its list of recommendations. The bill was passed in a conference committee last week and is expected to be approved by both houses and subsequently signed by Governor Healy without amendments.
ISPA is exploring how this legislation affects our goal of enacting our model mattress recycling legislation and plans to participate in the commission’s public meetings and submit public comments. We will keep you updated on any developments regarding this legislation.
