On February 6th, a U.S. District Court in Oregon issued a preliminary injunction in the National Association of Wholesaler‑Distributors (NAW) lawsuit challenging Oregon’s paper and packaging EPR law, known as the Recycling Modernization Act (RMA). This injunction temporarily pauses enforcement of the RMA against producers who are members of NAW while the case proceeds, with a full hearing scheduled for July 2026.

In July 2025, the National Association of Wholesaler-Distributors sued the Oregon Department of Environmental Quality (DEQ) to challenge Oregon’s paper and packaging EPR program, which launched on July 1, 2025. In short, the lawsuit challenges the constitutionality of the law and argues that wholesalers should not be considered producers under the law.

Circular Action Alliance (CAA), the producer responsibility organization approved to operate Oregon’s paper and packaging EPR program, issued this statement on how they are proceeding during the preliminary injunction. Oregon DEQ issued this press release about the injunction.
