In New York, a bill (NY S.7821A) that prohibits the sale of mattresses, children’s products, and upholstered furniture containing fiberglass unless they contain a prominent warning label passed a floor vote in the New York State Senate (60-1). ISPA does not support this legislation as it lacks a definition of “textile fiberglass” and creates an inconsistent regulatory landscape for mattress manufacturers. ISPA is actively engaging with Assemblyman Weprin, the Assembly sponsor of (NY A.7912B), which is cross-filed with S.7821A, to amend his legislation to include a definition of  “textile fiberglass.” 

ISPA prefers the approach to regulating fiberglass set out in separate legislation, NY A.8537 and NY S.8702. These bills include a definition of “textile fiberglass” that is consistent with CA AB 1059. Enacted in 2023, AB 1059 bans the sale, distribution, and manufacture of mattresses, juvenile products, or upholstered furniture that contains textile fiberglass, effective January 1, 2027. While a ban bill would usually not be preferable, ISPA supports A.8537/S.8072 over A.7912B/S.7821 as they create a consistent regulatory landscape for mattress manufacturers.
