As ISPA previously reported, critically flawed mattress recycling legislation that will harm the U.S. mattress industry is advancing fast in New York State. On April 12, NY S.1463A passed the New York State Senate despite ISPA’s numerous concerns outlined in this memo submitted to all New York State Legislators.  

S.1463A and its Assembly companion (NY A.1209A) are both currently referred to the Assembly Ways and Means Committee. ISPA has significant concerns with the legislation as currently drafted, including the lack of a clear, transparent funding mechanism, which will unfairly burden the domestic mattress industry. ISPA needs our members to engage on this critical issue.  

We urge members to fill out the company form letter below by Friday, May 1 and email it to the members of the New York State Assembly, listed below, to amplify our industry’s concerns about the legislation as currently drafted. 

ISPA supports mattress recycling programs built on a transparent, sustainable financing mechanism funded through a point-of-sale fee, as successfully implemented in California, Connecticut, Rhode Island, and Oregon. By contrast, S.1463A/A.1209A lacks a clear, transparent funding mechanism. Instead, costs would likely be embedded throughout the supply chain, creating uncertainty for manufacturers and retailers and placing domestic producers at a competitive disadvantage—particularly relative to foreign imports, where enforcement will prove costly and difficult.  

ISPA has also offered the existing Mattress Recycling Council (MRC) model—an approach with a proven track record—as an alternative, but these recommendations have not yet been incorporated into the legislation.  

Given the uncertainty around timing, we encourage ISPA members to initiate outreach now to ensure Assembly members are aware of stakeholder concerns in advance of any potential committee or floor action. Broad outreach ensures coverage regardless of when the bill is taken up.
