SB 1463B and AB 1209B lost momentum to secure the final passage before the New York legislature adjourned on Friday, June 5. As previously reported, ISPA initially opposed the legislation because it lacked point-of-sale fee language and other mandatory hurdles.  

Over the weekend of May 30, the Assembly adopted amendments that added the transparent fee language ISPA sought. ISPA then changed its position from oppose to support. The Senate updated its version to match the Assembly bill and passed SB 1463B on June 4. However, the Assembly did not bring its bill to a vote before adjournment.

Although the bill did not pass this legislative session, ISPA is encouraged that this is the furthest that beneficial mattress EPR language has made it in the legislative process over the past six sessions in New York. ISPA plans to reintroduce an updated bill in the 2027 legislative session.
