California FR Restrictions Coming into Effect 1/1/2027: Are You Ready?
In 2023, California enacted CA AB 1059 to restrict the use of certain flame retardants and textile fiberglass in mattresses. Mattress manufacturers selling into California should begin compliance planning now for the following bans on textile fiberglass effective January 1, 2027:
- A manufacturer, retailer, importer, or online seller shall not manufacture, sell, offer, or distribute in commerce any new, not previously owned juvenile product, mattress, or upholstered furniture that contains, or a constituent component of which contains, textile fiberglass.
- A custom upholsterer shall not repair, reupholster, recover, restore, or renew any mattress, juvenile product, upholstered furniture, or reupholstered furniture using a replacement component that contains, or a constituent component of which contains, textile fiberglass.
Mattress manufacturers should note the narrow exemptions in AB 1059’s textile fiberglass definition for (A) Thread or fiber when used for stitching mattress components together, and (B) Yarns in which the glass filaments are corespun or sheathed by another fiber.
A law enacted in 2018, CA AB 2998, exempted components of adult mattresses other than foam from California’s flame retardant chemical restrictions. AB 1059 eliminates this exemption on January 1, 2027. Thus, non-foam layers of mattresses, including thermal barrier fabrics, become subject to the same flame retardant chemical limits that currently apply to just foam. The exemptions for aramid fiber, when used in fabric in the interior of a mattress or on a nonsleep surface, and modacrylic fiber, provided it contains no antimony trioxide or other covered flame-retardant chemicals, do not expire.
