Mattress EPR Legislation Moving in Multiple States
As ISPA previously reported, nine states are considering mattress extended producer responsibility (EPR) legislation. Here are the key legislative developments from the third week of February 2026:
In Virginia, an ISPA-supported mattress recycling bill (VA HB 86) was voted out of the full Chesapeake, Agriculture, and Natural Resources Committee 19-3 and subsequently passed a floor vote of the full Virginia House of Delegates 67–30. In Maryland, legislation to establish a statewide mattress recycling program was introduced in the Maryland House of Delegates (MD HB 984) and State Senate (MD SB 603). These bills mostly follow the structure that has enabled the Mattress Recycling Council (MRC) to operate effectively; however, ISPA has a few technical amendments we are proposing to both bill sponsors. Thus, our position is “support with amendments.” ISPA will testify in Annapolis at hearings on February 24th in the Senate Education, Energy, and Environment Committee and on February 27 in the House Environment and Transportation Committee. In New Jersey, ISPA testified in support of NJ A 1651 before the Assembly Consumer Affairs Committee. The Committee approved the bill with a vote of 5–1, and A 1651 was reported to the Assembly Commerce and Economic Development Committee, where it will be heard next. ISPA anticipates the identical Senate Companion bill (NJ S 2359) will have a hearing in March before the Senate Environment and Energy Committee. Click here to read ISPA’s full letter of support.
In Hawaii, a flawed bill to establish a statewide mattress recycling program was amended into a study bill (HI HB 1924). If enacted, HB 1924 would convene a twelve-member working group administered by the Hawaii Department of Health to consider the development of a mattress extended producer responsibility program in Hawaii and report its findings to the Hawaii State Legislature. The working group would have seats reserved for a mattress stewardship organization, a mattress retailer, and a mattress manufacturer among others. If the study bill becomes law, ISPA will apply to join the working group and will keep our members updated on its efforts.
