Textile EPR Bills Introduced in New York and Washington State
New York State Senator Brian Kavanagh introduced NY S 3217 while Washington State Representative Kristine Reeves introduced WA HB 1420. Both bills would establish a manufacturer-funded extended producer responsibility (EPR) program for textiles (defined to include apparel and textile articles) in their respective states. Both bills are similar to California’s Responsible Textile Recovery Act of 2024 which was signed into law by Governor Newsom in 2024.
ISPA has concerns about each bill’s definition of “textile article” which includes the word “bedding”. ISPA was successful in excluding mattresses in California, given the MRC program in the state, however in these bills, the definitions appear to include entire mattresses or mattress components . ISPA will voice our concerns in both New York and Washington State as mattresses should not be included in these bills.
