So far in 2026, eight states are considering mattress extended producer responsibility (EPR) legislation. Here are the key legislative developments from the first week of February 2026: 

ISPA Supported Legislation: 

In Virginia, an ISPA-supported mattress recycling bill (VA HB 86) had a public hearing on Wednesday, February 4, 2026 in the Virginia House Agriculture, Chesapeake, and Natural Resources Committee’s (ACNR) Natural Resources Subcommittee. ISPA attended the hearing in Richmond and testified in support of this legislation. Importantly, HB 86 follows the structure that has enabled the Mattress Recycling Council (MRC) to operate effectively in existing states while allowing for the flexibility needed to make the program a success in the Commonwealth. The bill passed the Subcommittee (9 Y – 1 N) and will be heard next in front of the full House ACNR Committee on Monday, February 9. Click here to read ISPA’s full letter of support. 

In New Jersey, ISPA’s model mattress recycling legislation (NJ S 2359//NJ A 1651) was introduced in the State Senate and Assembly. ISPA supports this legislation and will work with interested stakeholders, including the Association of New Jersey Recyclers, to advance it during New Jersey’s 2026 Legislative Session.    

ISPA Opposed Legislation: 

In Washington, an updated draft of a flawed mattress EPR bill was introduced in both the Washington State House and Senate (WA SB 6271//WA HB 2633). While modest improvements were made after ISPA’s initial stakeholder engagement efforts, ISPA still must oppose the legislation due to countless unworkable provisions. Importantly, the bill lacks a provision enabling retailers to collect a point-of-sale fee to fund the program. The legislation also contains mandates to report multiple incalculable data points and burdensome operational requirements that would make running the statewide mattress EPR system challenging for any producer responsibility organization. Click here to read ISPA’s full written testimony. 

SB 6271 received a public hearing before the Washington State Senate Environment, Energy, and Technology Committee on Wednesday, February 4. ISPA presented testimony in opposition to SB 6271. February 4 is the deadline for bills to pass from Policy Committees in Washington. After the hearing, both SB 6271 and HB 2633 are considered dead for the 2026 Washington Legislative session and will not become law this year. ISPA expects these bills to be reintroduced next year. ISPA will continue to engage with the appropriate stakeholders to develop legislation that will enable the implementation of a successful mattress recycling program in the Evergreen State.    

In Hawaii, companion legislation (HI HB 1924//HI SB 2476) was introduced to establish a statewide mattress EPR program. While the bill contains some of the elements of effective mattress EPR legislation from ISPA’s perspective, multiple important components are missing, including key definitions, an essential antitrust provision, and clear oversight from the Hawaii Department of Health. ISPA submitted a letter of opposition for a public hearing of the Hawaii House Energy and Environmental Protection Committee on February 3 where HB 1924 was heard. During the hearing, the Committee noted that more time was needed to consider HB 1924 and decided to delay decision making on the bill until Tuesday, February 10.
