New York Fiberglass Ban Bill Advances
As ISPA previously reported, multiple bills to restrict the use of fiberglass in mattresses are under consideration in the New York State Legislature. On May 20th, NY A. 8537A was heard before the Assembly Environmental Conservation and Codes Committees and was referred to the Assembly Rules Committee. If enacted, A. 8537A would ban the sale of mattresses, children’s products, and upholstered furniture containing textile fiberglass effective December 1, 2029. A. 8537A and its Senate companion, S. 8702A, contain a definition of “textile fiberglass” that is consistent with California’s AB 1059. Enacted in 2023, AB 1059 bans the sale, distribution, and manufacture of mattresses, juvenile products, or upholstered furniture that contains textile fiberglass, effective January 1, 2027.
New York’s state legislative session is slated to end on June 4th. Lawmakers in Albany still have not reached a budget agreement and will have limited time to consider other legislation until they do so. ISPA will continue to monitor and engage with the multiple bills currently under consideration to regulate the use of fiberglass in mattresses as well as the mattress recycling bill still pending.
