As ISPA previously reported, Utah regulators last year promulgated but later paused a rule to require that online retailers make law labels for mattresses (and upholstered furniture) sold online easily accessible to Utah consumers before sale. Utah issued a regulatory pause in response to feedback from the furniture industry. Utah is now revisiting this issue as part of a broader set of changes to R70-101, Utah’s bedding, upholstered furniture and quilted clothing labelling rule. 

On July 15th, 2024, Utah published in the Utah State Bulletin a notice of substantive change to R70-101. In particular, Section R70-101-13(3)-(4) proposes that effective April 1, 2025, an online retailer of bedding and upholstered furniture must meet all of Utah’s labeling requirements that apply to brick-and-mortar retailers. For example, not only must the mattress being sold to the Utah consumer be labeled and tagged correctly, but the label must also be “easily accessible to the consumer for examination before purchase.” Refer to the cited proposed rule for further details regarding label display requirements and options. 

The Utah Department of Agriculture and Food will accept public comments on the proposed rule until August 14, 2024.
